Do You Qualify For Expungement Of Your Record?

In Michigan, if you have a criminal conviction in your past, you may be eligible to have your criminal record expunged. This is extremely valuable, in that, any potential employers or background checks will not show a criminal conviction.

To have your record expunged, you must receive verification from both the Attorney General’s office and the Michigan State Police that you are eligible to have your conviction set aside. You must then have a hearing before a Judge of the Circuit Court in which you reside to petition for your conviction to be set aside.

Michigan’s Expungement Process

Confirm Eligibility

You may qualify if you have no more than three felonies or three misdemeanors. However, certain crimes including specific violent offenses and drunk driving, are not eligible for expungement.

Collect Documents

Gather certified court records and your criminal history report, then complete the expungement application.

File and Notify

Submit your completed application to the court that handled your conviction, and ensure you notify both the Michigan Attorney General and State Police as required.

Attend the Hearing

Appear before a circuit court judge and present your case for expungement.

Once the judge reviews your case, a decision will be made. If your expungement is granted, the conviction will be set aside and removed from public records.
